Terms of Trade & Commercial Conditions

1. Nature of Website & Non-Binding Indications

This website is operated by Shine Star Trading Co., Ltd. for the dissemination of product technical specifications, grade parameters, container stowage guidance, and trade logistics information.

2. Incoterms® 2020 & Risk Transfer

All international shipments, price quotations, and transport bookings are governed strictly by Incoterms® 2020 as published by the International Chamber of Commerce (ICC):

• ▪FOB (Free on Board, Laem Chabang / Bangkok): Shine Star Trading bears all costs, export clearance charges, Thai customs dues, and port loading fees until cargo is loaded on board the vessel nominated by the Buyer. Risk of loss passes to the Buyer once goods pass the vessel's rail.
• ▪CFR / CIF (Cost and Freight / Cost, Insurance & Freight): Shine Star Trading contracts and pays ocean freight to the agreed port of discharge. For CIF terms, minimum cargo marine insurance is procured in accordance with Institute Cargo Clauses (C).
• ▪Container Fill & Stuffing: Stated container fill tonnages (e.g. 19–20 MT per 20ft container for damar batu or sticklac) represent target maritime stowage limits subject to steamship line weight restrictions and seasonal moisture variations.

In adherence to our trade discipline, every contract explicitly separates guaranteed rejection parameters from typical lot averages:

4. Pre-Shipment Inspection, Samples & Claims

To prevent disputes at discharge, goods are inspected and verified prior to container sealing:

• ▪Lot Reference Samples: Where agreed, an authentic physical sample drawn from the tendered lot is dispatched to the buyer's laboratory prior to shipment.
• ▪Pre-Shipment Inspection: Buyers maintain the right to inspect lots at our Bangkok yard or appoint recognized international survey agencies (e.g. SGS, Bureau Veritas) at buyer's cost prior to loading.
• ▪Discharge Notice Period: Any qualitative discrepancy or weight dispute at the destination port must be formally notified in writing within fourteen (14) calendar days of container discharge, supported by an independent surveyor's report. Sealed retained reference samples held at our Bangkok facility shall serve as final evidentiary benchmark.

5. Verification Protocol & Anti-Fraud Security

Due to widespread commercial identity spoofing in international commodities trade, strict verification rules apply to all transactions:

• ▪Authoritative Domain: All legitimate electronic communications, contracts, proforma invoices, and documents originate solely from @shinestartrading.com. Quotations received from free webmail accounts (Gmail, Yahoo, Hotmail) or mismatched domains are counterfeit and invalid.
• ▪Immutable Banking Details: Shine Star Trading Co., Ltd. does not alter bank beneficiary coordinates or remittance instructions via email during a transaction. Any notice requesting payment to an alternative bank, foreign account, or personal name must be treated as fraudulent.
• ▪Mandatory Voice Verification: Prior to releasing wire remittances (T/T), buyers are strictly required to verbally verify account details by calling our registered desks in Bangkok (+66 87 593 7207) or India (+91 79777 01799).

6. Export Permits, CITES & Force Majeure

Certain product lines, including select tropical timber species (such as Dalbergia, Diospyros, Swietenia), are regulated under the Convention on International Trade in Endangered Species (CITES) and national forestry laws.

7. Governing Law & Dispute Resolution

Unless otherwise stipulated in a signed Sales Contract, all transactions, agreements, and online trade terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
